17.10.2008 : FEI Tribunal Takes a Final Decision in the Prohibited Substance Case Involving the Horse LANTINUS

The panel of the FEI Tribunal has rendered its final decision in the prohibited substance case involving the horse Lantinus 3 ridden by Denis Lynch (IRL) at the 2008 Olympic Games.

The Person Responsible (the rider) is suspended for a period of three months (90 days), which period began on the date of the application of the provisional suspension, 21 August 2008, and shall run up to 21 November 2008. The Person Responsible (PR) is fined CHF 1,750 and shall also contribute CHF 2,000 towards the costs of the legal procedure as the proceedings were further complicated by the numerous intermediary filings by the PR. The horse and the rider are disqualified from the entire Olympic Games.

The justifications for the sanctions are the principles which are at the core of the FEI Equine Anti-Doping and Medication Control Rules, according to which

“It is each Person Responsible's personal duty to ensure that no Prohibited Substance is present in his or her Horse's body during an Event. Persons Responsible are responsible for any Prohibited Substance found to be present in their Horse's bodily Samples. Accordingly, it is not necessary that intent, fault, negligence or knowing Use on the Person Responsible’s part be demonstrated in order to establish an anti-doping rule or medication control violation.”

In reaching its conclusion the Tribunal concluded the substance at issue – Capsaicin – was a “Medication Class A” rather than a “Doping” substance based on its interpretation of the list of prohibited substances.

In considering the sanctions to be given to the PR in this case, the Tribunal took into account:
- the fact that the PR is an experienced sportsman and that the behavior of anyone at the top of the sport and particularly at the Olympic Games must be faultless since the eyes of the world focus on performances at such events;
- the nature of the substance involved – Capsaicin - which is not only a pain relieving substance, but also an agent that can be used for hypersensitisation purposes;
- and the fact that the sources of the presence of the substance argued by the PR indicate negligence of the PR by using a "pain relieving" substance, including at the Event, on the horse’s back, without checking whether it contains any prohibited substances.

On the other hand, and in mitigation, the Tribunal also considered:
- the clean record of the PR, prior to the present case;
- the hardship already caused to the PR
- the identification and evidence produced by the PR, as early as during the preliminary hearing, regarding the sources of the presence of the substance;
- and the substance is a newly detectable substance which is often used by riders also for legitimate therapeutic reasons.

PROVISIONAL DECISION ON DENIS LYNCH BY FEI TRIBUNAL

HORSE Sport Ireland was today (Monday) informed by the world governing body, the FEI, that show jumper Denis Lynch will remain under provisional suspension from international competition until the final decision on the medication case involving his horse 'Lantinus' is issued by the FEI Tribunal.

Lynch appeared before the Tribunal at Lausanne, Switzerland last Saturday, September 6.

The Tribunal indicated that it expects to issue a final decision by 30 September, and has also indicated a timeline that allows for additional correspondence between the parties, including deadlines for additional statements and pleadings.

Denis Lynch was automatically suspended by the FEI following a positive medication test on his horse ‘Lantinus’ on August 21, 2008, at Hong Kong during the Olympic Games.

06.09.2008 : MEDICATION CASE HEARING IN LAUSANNE

THE judicial hearing by an FEI Tribunal in Lausanne, Switzerland regarding the Denis Lynch Olympic medication case concluded today (Saturday) at approximately 5pm Irish time. Afterwards Denis Lynch said: "I am very happy with the way things went. I was able to put my case fully and I believe I received a fair hearing."

The FEI Tribunal confirmed to Denis Lynch that it will issue a provisional decision on the matter on Monday September 8. This will deal with whether Denis’s suspension will be lifted pending a full judgement on the case, which is expected by the end of September.

Denis Lynch was automatically suspended by the FEI following a positive medication test on his horse ‘Lantinus’ on August 21, 2008, at Hong Kong during the Olympic Games.

FEI CONFIRMS LANTINUS 'B' SAMPLE IS POSITIVE

EQUESTRIAN'S world governing body, the FEI, this evening (Wednesday) confirmed that the B samples from the four cases (including ‘Lantinus’) at the 2008 Olympics involving the presence of the banned substance capsaicin in horses, have all yielded positive test results, thus confirming the initial positive findings from the A samples.

The four cases are:
Bernardo Alves (Brazil); Chupa Chup
Christian Ahlmann (Germany); Coster
Denis Lynch (Ireland); Lantinus
Tony Andre Hansen (Norway); Camiro

The process will now follow the Accelerated Medication Control Procedure during and after the 2008 Olympic Games which is part of the FEI Regulations for Equestrian events at the 2008 Games (Annex G), available on the FEI Olympic website.

Evidence and written submissions have been requested from each rider, and a three-member panel of the FEI Tribunal has been appointed. Hearings will be held on 5, 6 and 7th September in Lausanne, Switzerland.

Horse Sport Ireland tonight confirmed that they had been informed by Denis Lynch that he would be taking up his right to a hearing and that he intended to make himself available on any of the dates proposed by the FEI.

I didn't cheat, why would I cheat?

If the news for Denis Lynch in Hong Kong on Thursday was shattering, it wasn't much better back in his native Tipperary on Friday.

The newspaper headlines were rough, reporters were besieging the family home and his parents had had a sleepless night.

His horse, Lantinus -- ranked number one in the world -- had tested positive for a banned substance, he'd been suspended from the Olympics just hours before the showjumping final and his reputation as an honest sportsman had been tarnished.

Aggrieved by the media coverage and distressed for his family, Lynch, in the early hours of Saturday morning Hong Kong time, spoke by phone from his hotel bedroom to the Sunday Independent in a bid to set the record straight.

"I didn't cheat," he said, "and I've no reason to cheat. I'm on the best horse in the world, why would I cheat? I've won four five-star Grands Prix (this year), I'm in the top 20 in the world, I know what I've done all year and I did nothing different (for the Olympics)."

Lantinus has been tested 12 times this year and Lynch voluntarily submitted the horse again for testing after the 10-year-old gelding arrived in Hong Kong for the Games, "to make sure the horse was clean".

This was his 11th test, the result was negative. The 12th was taken after the second round of jumping last Sunday. At about 2.15pm on Thursday Lynch was informed by the showjumping team manager Robert Splaine that this test had produced a positive result.

They met with officials and veterinarians from the international equestrian federation, the FEI, who told them that traces of a substance called capsaicin had been found in the animal's sample. It had been found in three other horses which were also banned from competing in the final.

At a subsequent press conference senior FEI officials said capsaicin was a prohibited substance because its pain-relieving properties were potentially performance-enhancing. It also had "hypersensitisation" properties: if applied to a horse's shins it could inflame them, thereby inducing the animal to jump higher to avoid painful contact with a fence -- a practice known as 'chemical rapping'.

Paul Farrington, a vet with the FEI, said capsaicin had always been banned but only recently had a test been developed to detect it.

But Lynch claims that "the FEI moved the goalposts" for the Beijing Games. "How can a horse test negative all year and then test positive when I've changed nothing? That's the question. I didn't change anything, I did nothing different (for the Games), why change anything when I was doing the same thing all year and winning?"

The substance is contained in an ointment sold commercially as Equi-Block. "I've been using this product for eight years," said Lynch. "And a lot of international riders have been using the product for the last eight years, over half of them I would say. You can buy it from every vet, in every tack shop, at shows all over the world. It does not make a lame horse sound, it does not make a horse jump higher. It's a cream that we rub on a horse's back to warm him up and make him loose."

Lynch said he was the only one of the four suspended riders who spoke to the media after the story broke. During his press conference he produced a tub of Equi-Block. The label on the product has a specially highlighted piece of information: 'Contains CAPSAICIN. Will not test positive'. Did this not trigger alarm bells for Lynch?

"But everyone's been using it! Fifteen horses were tested and four were positive. If 40 horses were tested then 14 would have tested positive and what would have happened then? If you use it (Equi-Block) over eight years and I've been tested and tested and tested, why would you think it was a doping product? It's not about cheating, it's got nothing to do with cheating."

But shouldn't he have checked out what sort of substance capsaicin was, given that it was linked with the words 'positive' and 'test' on the label of the product? "Do you know how much (capsaicin) is in the cream? Well I don't either. And yesterday (Thursday) the FEI couldn't tell me how much of the substance was in the sample. They couldn't say how long he (Lantinus) was positive: was it two days in his system, was it two hours in his system? They couldn't tell me anything."

He also rejected any suggestion that he was engaged in chemical rapping. "Jesus I don't have a clue about it. I've used it on horses' backs, that's it. There's no ifs and buts anymore. That's all. I've got nothing to do with it, I know nothing about it, I never want to have anything to do with it."

On Thursday evening while the final was underway, Lynch returned to his hotel and "closed the door". He didn't watch the final on television, he was in a state of shock. On Friday morning he woke up to headlines that humiliated him and news from home that upset him further.

"My mum called me and said reporters were there tormenting them. She hasn't slept, my father hasn't slept. They're getting hammered by the media. It's sickening. Sickening. I've got fantastic support from my family, my friends, my sponsors, people in Tipperary and from all around the country. And then to be slaughtered like that -- it's wrong."

Lynch, 32, and his horse jumped three rounds in Beijing. The first two were clear bar time penalties and in the third he faulted only at the water jump. The combination was in superb form and on course for a high finish in the final.

"I belonged in the ring that day. That was my dream. I worked 15 years to get there. I didn't go to the Olympics hoping to come 17th or 24th or whatever. I went there with a realistic chance of a medal. And then to be shot down like this . . ."

He knows he will be suspended from competition for a period of time. "But whatever (sanction) they give me will be nothing compared to this. To have everything taken away from you -- the biggest thing you could ever do in this sport is to represent your country at the Olympics and to have it taken away from you like that is a total shock."

Yesterday morning Lynch left Hong Kong for Germany where he lives with his partner Simona and their four-year-old daughter. He will return to Tipperary town "to thank the people for their support before the Olympics and especially for their support now. And afterwards life has got to move on."

But he left Hong Kong behind him with a world of regrets. He admits to being stunned and incredibly disappointed. "I went out there on a mission: to win a gold medal, or a medal of some sort, and that was it. Nothing else.

"And up to a quarter past two yesterday, everything was perfect."

Team vet insists that rider was 'totally unaware' of the dangers

Ingredients:
Active Ingredient: Capsaicin (0.025%)
Other Ingredients: Deionized Water, Chamomile Extract, Carbomer 940, Polysorbate 20, Triethanolamine, Propyl Gallate, Methylparaben, Imidazolidinyl Urea, Propylparaben, Fragrance.

IRISH team vet Marcus Swail last night insisted show jumper Denis Lynch was "totally unaware" of the danger of using the lotion that led to his disqualification from the Olympic show jumping final.

The 32-year-old Tipperary-born rider was disqualified from competing in the individual show jumping final on Thursday when it was revealed that his horse, Lantinus, had tested positive for a banned substance called capsaicin.

"When I told Denis about the test result we were close to the horse's stable and he turned around and walked straight over to Lantinus' stable door," Swail said.

"There was a wooden tack-box hanging over the front of the door with grooming things in it and the horse had his head hanging out over the top of it.

"Denis put his hand into the box and pulled out a tub of Equi-Block, saying that he thought it contained capsaicin -- now if you knew it was illegal to use it, you would hardly leave it sitting in a box at the front of the stable where anyone could see it would you? Denis was horrified."

The Irish contingent in Hong Kong are aware of the tidal wave of criticism being directed toward them following the latest humiliating disqualification from the Games.

Yesterday, they were holed up in their hotel while Typhoon Nuri blew through, leading to delayed departures for horses, competitors and officials.

"I've heard that people have been saying how can we all have been so stupid," Mr Swail said.

"But I would say to that -- if you were Denis Lynch and you used that preparation all the time and the horse was tested seven or eight times over the nine months since you had him and each time the test was negative and you never heard of a positive result for this product -- would it not be reasonable to believe it was fine to use it?"

The banned substance capsaicin creates a burning sensation and, if applied to a horse's legs, "could hyper-sensitise them and make them jump better in competition", a press conference heard earlier this week.

However, Mr Swail insisted Equi-Block has little or no burning effect when applied to the skin.

At the hastily convened Irish team press conference last Thursday night, the Irish veterinary surgeon said, "I invite you to come up here and try it" as he laid the tub of Equi-Block on the table.

Written on the label was "contains capsaicin", with the additional claim that horses will not test positive when the substance is applied. "If you were hoping to create a burning sensation with it, then you would be looking for your money back," he pointed out.

"Denis uses it to loosen muscles on his horse's lower back as part of his normal routine," Mr Swail explained.

Abusive

The FEI has only recently broadened its screening programme to search for capsaicin in the belief that it is being used in an abusive manner to make horses jump more carefully.

"The rules are changing all the time and people are getting caught up by mistake. Denis doesn't deserve this," Mr Swail insisted.

HORSE SPORT IRELAND - STATEMENT ON DENIS LYNCH

20/08/08 HORSE Sport Ireland (HSI) was informed by the world equestrian governing body, the FEI, at 2.15 pm Hong Kong time today (Thursday), that Irish Olympic rider Denis Lynch's horse 'Lantinus' had tested positive for a banned substance and that as a result he would be suspended from taking part in tonight's show jumping final.

Denis Lynch and Horse Sport Ireland officials attended a preliminary hearing with the FEI a short time ago and were informed that the substance found in the horse was called capsaicin.

At the tribunal the FEI indicated that this substance was an ingredient in some products in regular use. Subsequently it was identified by Denis Lynch as an ingredient in a product called "Equi-block" used by him on his horse. Equi-block is a product used in similar circumstances to 'Deep Heat' used on humans and Denis Lynch explained to the tribunal that he commonly applies Equiblock to the horse's lower back prior to exercise.

Denis Lynch holds up the tub of a Equi-Block, which contains capsaicin, during yesterday's press conference in Hong Kong. The label claims that it will NOT TEST POSITIVE and vet Marcus Swain invited journalists to rub the lotion into their own skin.

Following this preliminary hearing today the FEI informed Denis Lynch that he remained suspended for tonight's competition.

The FEI have subsequently confirmed that three other riders due to jump in tonight's final at Hong Kong have also been suspended as a result of the same substance being found in their horses.

Horse Sport Ireland has confirmed that they submitted a urine sample from the horse to a voluntary screening testing process made available by the FEI on the horse's arrival in Hong Kong and the results of this test were negative.

The horse has also been tested on numerous occasions, including following many of its recent victories, and has tested negative on all these occasions.

18.08.2008 : LYNCH INCURS SIX FAULTS ON THIRD QUALIFYING ROUND

DENIS Lynch and 'Lantinus' incurred just six faults on their third qualifying round at Hong Kong today (Monday), bringing their total tally to eight faults. 'Lantinus' touched the tape of the water jump on the way out, but dropped no poles on his round, and the combination also picked up two time faults.

Lynch and 'Lantinus' were lying in fourth place after the individual segment, but the team competition is still taking place today, and this will alter the scoreboard for the individuals as well. Though an eight fault total seems almost certain to qualify Lynch for Thursday's Olympic Final.

After the round, Irish Team Manager Robert Splaine said: "It was another top class performance from Denis Lynch. He disturbed no poles and Lantinus's touch of the tape on the water jump was uncharacteristic. And as a similar technicality may well come up on the final course, Denis will know not to under-ride it. It is something that is easily rectified. This is a step-by-step process, and I think Denis is handling it brilliantly."

17.08.2008 : LYNCH DELIVERS AGAIN IN SECOND QUALIFIER

SHOW Jumper Denis Lynch delivered another world class round with the 10 year-old gelding 'Lantinus' in the second Olympic qualifying competition at Hong Kong today (Sunday) with no jumping faults and a single time fault to add to his existing tally, bringing him to a total of just two faults prior to Monday's third qualifying round.

Jumping 11th of 76 riders, Tipperary-born Lynch was the first rider in today's class to leave all the poles intact on an intimidating track.

Afterwards Irish Team manager Robert Splaine said: "This is a significant step for Denis and Lantinus. It gives him a very good chance of qualifying for Thursday's final, but there is still a lot of big jumping to be done tomorrow, when the course will again be completely different. But this was a remarkably good performance today."

The final of the individual jumping competition will be held on Thursday August 21st, when the top 35 riders left in the competition will be reduced to a top 20 who will fight for medal positions in the last OIympic jumping round.

15.08.2008 : LYNCH INCURS ONE TIME FAULT IN FIRST QUALIFIER

IRELAND'S Denis Lynch incurred just one time fault in his opening Olympic round at Sha Tin, Hong Kong this afternoon (Friday), and will now go through to the next individual qualifier on Sunday.

Riding the 10 year-old gelding 'Lantinus', the Tipperary rider left all the poles standing, and ran slightly over the allowed time for the course.

Afterwards irish Team manager Robert Splaine said: "It's a game of tactics at this stage. Denis, I think, knew well he would incur a time fault, but the horse has to be saved for the next two rounds of jumping on Sunday and Monday, when the competition will become seriously difficult."

Lynch finished in joint 14th position in the first qualifier, but the faults incurred today are the vital element, for they are converted into points to be carried forward to the next qualifier on Sunday. Thirteen riders shared first place on a zero score, and 14 riders shared 14th place. A total of 77 riders took part.

The final of the individual jumping competition will be held on Thursday August 21st, when the top 35 riders left in the competition will be whittled down to a top 20 who will do battle for medal positions in the ultimate round.

14.08.2008 : LANTINUS PASSES HORSE INSPECTION

A total of 87 Jumping horses were presented for veterinary inspection at the Olympic equestrian venue in Sha Tin, Hong Kong this morning (Thursday) and all passed with flying colours, with no visitors to the holding box.

This included ‘Lantinus’, the horse which will be ridden by Ireland’s Denis Lynch in the first jumping qualifier tomorrow.

There were three changes to the Olympic Jumping start-list yesterday (Wednesday) when it was confirmed that Michael Whitaker's Portofino, Alvaro Mirando Neto's Ad Picolien and Daniel Meech's Sorbas were all withdrawn.

The loss of the experienced Portofino is a major blow to the British team, but the 14-year old mare had been suffering from intermittent bouts of lameness over the previous few days and a decision was taken to withdraw her and call up the reserve partnership of Nick Skelton and Russel as replacements.

Skelton will be competing in his fifth Olympic contest when the action begins tomorrow (Friday) evening and his presence is all the more remarkable for the fact that he suffered a broken neck in September 2000 but made an amazing recovery to return to the sport at very top level.

For Alvaro Miranda Neto there was disappointment when Ad Picolien was declared unfit, and the man who finished 12th individually at the Athens Olympic Games in 2004 and who was a member of the bronze medal winning Brazilian team at the Sydney Olympics in 2000 will now be obliged to watch his colleagues Bernardo Alves (Chupa Chup), reigning Olympic champion Rodrigo Pessoa (Rufus), Pedro Veniss (Un Blanc de Blancs) and Camilla Benedicto (Bonito Z) from the sidelines.

Daniel Meech will be replaced by Kirk Webby and Sitah on the New Zealand team. Had he been in a position to compete, this would have been Meech's second Olympic outing as he previously rode Diagonal in Athens.

Fellow-Kiwi Katie McVean's 16-year old Forest was one of the eye-catchers of the morning but, for many, the man of the moment was Jos Lansink's much-loved stallion Cumano who has only recently returned to the ring after an enforced break due to the tendon injury he suffered last autumn. Cumano is always a show-stealer with his flashy jump and he looked in great shape today.

If the 15-year old horse can find anything like his top form then the reigning World Championship partnership will be among the ones to watch when the competition begins tomorrow night.

13.04.2008 : Presse - Irischer Sieg in Doha

13.04.2008 : Presse - LYNCH SCOOPS 100,000 EURO GRAND PRIX IN QATAR

THOUGH he'd already been in serious contention at the first leg of the five star Global Champions Tour, Tipperary-born Denis Lynch pulled off a surprise victory tonight (Saturday) when he won the 100,000 euro first prize in the Qatar Grand Prix at Doha.

The 31 year-old Irish rider faced a daunting field that included many of the world's top riders and horses, but kept a clear head through two clear rounds to qualify for a five-horse jump-off. And though under huge pressure, he brought Flaminia Straumann's talented ten year-old bay gelding 'Lantinus' across the line less than half a second ahead of German challenger Alois Pollman-Scheckhorst to claim the generous prize purse.

Horse Sport Ireland Chairman Joe Walsh afterwards congratulated Denis Lynch on what he described as ‘an outstanding win’.

Ireland's other contender, Jessica Kurten, was less fortunate, dropping a single pole in the second round on Lady Georgina Forbes's 'Castle Forbes Libertina', and therefore not qualifying for the jump-off, but the Antrim-born rider did pick up 3,000 euro for her eventual 14th place.

14.01.2008 : Nachtrag - Vorbericht CSN Gahlen 2008

Also womöglich doch „a long way from Tipperary“…..
